TESTATOR FAMILY MAINTENANCE - YOUR RIGHTS

When families lose a loved one, it is often very difficult to even think about Wills of estates at such times.

A family is often surprised to find that despite assurances made by several family members, no provision has been made for them through the Will. This is usually for a number of reasons, however family disputes can tend to inflame these issues.

Luckily, the law provides that for family members and in some cases dependents of the deceased, an application may be made to the Court by way of Testator's Family Maintenance for the Court to consider whether or not that particular family member or dependent is entitled to any part of the estate.

There are strict time limitation periods that apply for these applications and people should ensure that they see a solicitor before nine months has expired from the date of the death.

Again this is a complicated area of law, however for most family members, this may mean the difference between financial hardship and financial security.
