INCLUDED CHATTELS

If there is anything on the property that a perspective Buyer wants included with the purchase of their dream home, make sure it is included in the “Included Items” section on the Reference Schedule. 

 

Some items that need to be inserted as an Included Chattel are as follows:-

 

Water Fountains;

Pool Equipment;

Alarm System;

Any items of furniture;

Cubby Houses;

Swing Sets;

Dishwasher;

Pot Plants;

Staghorns;

 

Technically, should an Included Chattel not be present or be damaged at the time of settlement, settlement still has to occur.

 

To be sure that these items will be left prior to settlement and be in the same state they were at time of inspection, a special condition should be inserted as follows:-

 

This Contract is subject to and conditional upon the fixtures and or item/s referred to as “Included Chattels” in the contract schedule remaining on the property as inspected by the Buyer prior to executing this contract and remaining in the same state or condition at the date of settlement.  Should such fixtures and or items be removed from the property and or not be in the same state or condition as inspected by the Buyer prior to executing this contract then the Buyer shall be at liberty to terminate this Contract prior to the date of settlement and all monies payable hereunder shall be refunded in full.
